The questions and answers on the present site have been collected and published through the platform of Q3 AMP edited by the company Q3 SAS, full details for which can be consulted on www.q3-advocacy.com.
By using this dialogue service between “web-user and customer”, “web-user and brand” or “web-user, customer and brand”, you certify to accept the terms of the present document and to be aged 18 or above, or to act with parental consent if you are under the age of 18.
In the event that the author of a question or of a reply does not respect the above terms, his/her question or reply will be rejected by the Community Managers of this site.
Aside from the terms, your use of the site is equally subject to the general terms and conditions for use of the website for client reviews (http://.avisesf.net/avis/) which can be consulted at http://www.avisesf.net/avis/cgu.
2. General Terms and Conditions for the dialogue site www.aviesf.net/dialogue
a. Participation. In order to use this site you must go to http://www.avisesf.net/dialogue/
When a question is sent: an input field allows you to enter your question. When you click on “Send my question” you access a first interstitial allowing you to choose at least one criteria from amongst a series of qualifying criteria. Following validation of this first interstitiel, a second interstitiel allows you to enter the following obligatory information: First name, surname and email.
Any question issuing from a web-user attempting to use the identity of another web-user will be deleted.
Email address will allow you to receive the emails notifying you of replies to your question. Your email address will be visible neither online nor when you send your question to ESF customers.
Only your first name and the first letter of your surname will be communicated online and to customers.
When an answer is sent by a web-user: Only satisfied ESF customers who have previously given their agreement to reply to web-users’ questions will be contacted by email. When a customer replies to a web-user’s question, information relating to the type of lessons this customer took at ESF along with his first name and the first letter of his surname (information provided by the customer at the time of purchase on-line of his lessons) will be communicated when replies are sent and published on-line on this website.
Information relating to the type of lessons taken are as follows:

The month the lessons were taken
Type of lesson: Group lessons, competition lessons, private lessons
Age of the student: Children 3 to 6 years, children 7 to 12 years, teenagers, adults.
When searching for an answer:
The Dialogue site allows users to consult conversations published on-line (questions + answers) between web-users and customers or between web-users and the brand. All the questions which have been answered can be consulted on http://www.aviesf.net/dialogue/. To search for conversation relating to a specific theme just type in key words in the question’s entry bar: conversations relating to similar terms will be displayed at the bottom of the page.
b. Minors. Users must be over the age of 18 to submit questions to ESF customers on the Dialogue site. If you are under 18 you will need to have permission from your parents or legal guardian to use this service.
c. Non-interference. You consent to in no way disrupt or interfere with the functioning of the Dialogue site.
d. Respecting the law. It is prohibited to publish or submit user Content (as the term is defined below in point f. of the present document) whose aim is to promote, commit or serve an illegal act.
e. Acceptable behaviour. It is understood that you will publish or submit user Content by employing language suitable to the subject matter and adapted to general conversation without resorting to defamatory, insulting, untruthful, obscene, sexual or injurious references (in any context linked to sexual, racial, cultural or ethnic characteristics).
f. Control rights. Without obligation or responsibility and without warning, ESF may proceed with a pre-selection, control and/or examination of the content appearing on the Dialogue site in search of user’s inappropriate subject matter or unacceptable behaviour. In order to implement the present conditions, “User Content” denotes all texts (web-user Questions or Answers or ESF Answers), links (this includes, notably, linked sites as defined in point k. of the present Terms) or any other information and material made available or submitted to the Dialogue site. You acknowledge that ESF cannot be held responsible for pre-selection, control and/or examination (or the omission of said operations) of content appearing on the Dialogue site in the search for inappropriate user Content or unacceptable behaviour.
g. Advertising and spam. It is prohibited to use the Dialogue site for the promotion, sale or commercialisation of any activity, product or service to other users (e.g. user Content with the aim of advertising a book, service, software or other product or service for sale).
h. User Content. You acknowledge that the author of all user Content, public or private, takes full responsibility for what he writes. You therefore assume full responsibility for the user Content you publish, submit or send via the Dialogue site. ESF cannot guarantee the exactitude, pertinence, integrity, acceptability or quality of the answers given by its customers during an exchange with other web-users on the Dialogue site. You acknowledge that ESF cannot and does not guarantee that users will not make other use of user Content which you share. Consequently, refrain from publishing user Content on the Dialogue site which you wish to remain confidential and/or to prevent its use by others. ESF is not responsible for the abusive use or fraudulent appropriation of user Content published by you on the Dialogue site. You undertake to not include, through reference or not, personal details relating to you or any other person (e.g. email addresses, postal addresses or telephone numbers) in the user Content you publish or make available on the Dialogue site. If you submit, publish or make available user Content on the Dialogue site you give ESF, its representatives, affiliated companies and sub-licensees, the authorisation and free, irrevocable, worldwide, transferable, non-exclusive and entirely transferable, right by sublicense:
a) to quote, re-publish, use, reproduce, store, modify, adapt, translate, license, print, distribute, transmit, screen, communicate, publicly display and create derivative works from all or part of the user Content on the Dialogue site.
b) To use, reproduce, store, publish, translate, distribute, transfer, screen, communicate and display your first name and initials of your surname that you submit when you publish the aforementioned user Content on the Dialogue site, and that means in any manner or by any means or methods (this includes, notably, forums and discussion spaces), already known or to come, and without forewarning, counterbalance or attribution of any nature in your favour, that of your beneficiaries or any other third party person. The present point does in no way anticipate any resignation or renunciation of the moral rights you possess as the author.
ESF reserves the right, at its own discretion, to reject any user Content that you submit: in this case, ESF undertakes to write to you to inform you of this rejection.
a) violates the Terms
b) violates the law or damages the reputation of the Dialogue site or any other website or the ESF brand.
The decision to reject user Content is not open to appeal and is taken at the entirely at the discretion of ESF.
j. Violation of the Terms. ESF may disclose any information it possesses about you (including your identity) to a competent authority who makes a valid request, if the brand judges this information relevant to an enquiry or for the handling of a complaint with regard to your use of the Dialogue site or in order to identify, contact or introduce a legal action against any person suspected of bringing prejudice or obstruction (intentional or not) to the rights or to the property of ESF and/or companies affiliated to ESF, or to Dialogue site visitors or users including ESF customers. ESF reserves the right to disclose at any time, any information the brand considers necessary in accordance with the laws and regulations applicable, for judiciary procedures governmental requests. ESF may also disclose your details if they consider that the laws applicable require or authorise this disclosure, notably in the exchange of information between companies and organisations in the pursuit of the protection against fraud. You acknowledge that ESF can store any information you send to them or communicate through the Dialogue site and that the brand can also disclose this information and/or user Content, as required in the case of legal demand or if this storage or disclosure is reasonably necessary:
1) in accordance with judiciary procedures
2) in enforcing the Terms
3) to respond to allegations that the information of user Content in question violates the rights of a third party
4) to protect rights, property or personal security of ESF, it’s employees, users or visitors to the Dialogue site and general public.
You accept that ESF may, at its own discretion and without forewarning, block your power to write user Content on the Dialogue site if ESF considers that you have violated the Terms. You also acknowledge that any violation of the Terms will be considered an unfair illegal commercial practice and will cause irreparable harm to ESF for which pecuniary damages are insufficient and ESF could obtain, by way of injunction or equity, any measure of restitution considered necessary or appropriate to the circumstances. These measures of restitution are in addition to other means of recourse open to ESF.
k. Absence of agreement. Links to other, independent, third-party websites (“Linked sites”) may be included in the user Content. Linked Sites are not controlled by ESF who will not guarantee nor accept responsibility for their content. Moreover, ESF is in no way responsible nor guarantees, nor accepts reviews, communications, content, information, recommendations, declarations or public opinion published on the Dialogue site as their own or representing their views and ESF expressly declines all responsibility relating to user Content. By authorising the publication of user Content on the Dialogue site, ESF in no way signifies its agreement with reviews, communication, content, information, recommendations, declarations, opinions or stance reflected by the said user Content.
p. Disclaimer. ESF does not guarantee that the Dialogue site and its content, services and functions will be exempt from error or accessible without interruption, nor that defects will be corrected. The Dialogue site and its content are provided “as it stands” and “with reserve of availability”. All information provided on the Dialogue site is susceptible to deletion without forewarning. ESF declines to provide any form of guarantee, explicit or implicit, notably any guarantee relating to the exactitude, the non-infringement, the quality of user Content. In particular, it is in no way guaranteed that the Dialogue site should reply to your demands or that all information obtained through the use of the Dialogue site will be exact or reliable.
ESF also declines all responsibility for the acts, omissions or behaviour of Dialogue site users. In the event of a disagreement with a user who was put into contact with you, you will have the possibility to report this user’s behaviour on your conversation page. ESF reserves the right to judge if the user’s statements should be rejected. If you are unhappy with the Dialogue site, your only recourse against ESF will be to stop using the Dialogue Site.
q. Limitation. ESF reserves the right to carry out one of the following actions at any moment and without forewarning: 1) To modify, suspend or block the operation or access to all or part of the Dialogue Site for whatever motive whatsoever 2) To modify all or part of the Dialogue Site and all rules and conditions applicable 3) To interrupt the operation of all or part of the Dialogue Site for the purpose of maintenance periodically or not, to correct errors or bring modifications.
r. Applicable Law and competent jurisdiction. The Terms are governed by French law. You acknowledge the competence of the French courts and renounce all objection as to its competence.
s. Severability. The declaration of invalidity or inapplicability of any one of the dispositions laid out in the Terms will have no effect whatsoever on the rest of the Terms which will be deemed to be amended in the strictest way necessary to their validity and applicability.
3. Additional measures specific to the Dialogue site.
In addition to your obligations cited in the Terms above, ESF applies certain additional rules which you must respect when using the Dialogue Site.
a. Commercial users. The Dialogue Site’s principal aim is for users to help each other. Manufacturers, providers, retailers or tradesmen are not authorised to publish or submit comments or information that is either promotional or publicity relating to their services via the said service.
b. Forbidden User Content. In addition to the restrictions cited above in the present Terms, you can in no case submit or publish Comments or other user Content which has no bearing on the lessons provided by ESF. Below is a non-exhaustive list of examples of forbidden comments:

◦ Advice which could be prejudicial, fraudulous or untrue
◦ Criticism or personal attack of another user
◦ Tarifs or services provided by competitors
